These terms set out the gentle ground rules for using your Elarbaby monitor and the Elarbaby app — please read them so we can keep your family's experience safe and clear.

These Terms of Use ("Terms") form an agreement between you and Shenzhen Yiji Digital Technology Co., Ltd. (深圳市蚁集数码科技有限公司) ("Elarbaby", "we", "us" or "our"). By creating an account, downloading or using the Elarbaby app, or setting up and using an Elarbaby monitor, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use our app or services.
Elarbaby provides baby-monitoring hardware — including the Elarbaby View (WiFi video monitor), the Elarbaby Cosy (2.4GHz FHSS local monitor) and the Elarbaby Duo (WiFi monitor with a 5-inch parent unit) — together with the Elarbaby companion app for iOS and Android (together, the "Service"). The Service is provided by Shenzhen Yiji Digital Technology Co., Ltd. We may add, change or discontinue features of the Service over time to keep it safe, reliable and useful.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Elarbaby app on devices you own or control, solely for the purpose of setting up and using your own Elarbaby monitor for personal, non-commercial purposes. This licence does not transfer any ownership in the app or its underlying technology to you. You may not sublicense, sell, rent or otherwise make the app available to others.
To use connected features you will create an Elarbaby account. You agree to:

Please read this section carefully. An Elarbaby monitor is an aid only. It is designed to help you keep a caring, informed eye on your child — it must not be relied upon as a substitute for direct adult supervision.
By using the Service you acknowledge and accept these safety limitations.
The Service is provided on an "as is" and "as available" basis. While we work hard to keep your monitor and app running smoothly, we do not warrant or guarantee that the Service will be uninterrupted, timely, secure or free of errors, or that every alert will be delivered. Live streaming and alerts depend on factors such as your home network and internet connection, which are outside our control.
Your Elarbaby hardware may come with a separate limited hardware warranty, described on our support pages; that warranty is in addition to, and not limited by, this section. To the fullest extent permitted by applicable law, and except for that hardware warranty and any rights you have as a consumer that cannot be excluded, the Service and software are provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by applicable law, Elarbaby and Shenzhen Yiji Digital Technology Co., Ltd. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or relating to your use of, or inability to use, the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. Where our liability cannot be excluded but can be limited, it is limited to the amount you paid for the relevant product.
The Elarbaby name, logo and other brand marks, together with the Elarbaby app, its design, content and underlying software, are owned by Shenzhen Yiji Digital Technology Co., Ltd. or its licensors and are protected by intellectual-property laws. Except for the limited licence granted above, these Terms do not give you any right to use our marks, software or content.
In addition to our own products, we offer bespoke OEM/ODM customization services for business partners and sellers. Any such engagement — including white-label hardware, branded apps and supply arrangements — is governed by a separate written agreement between us and the partner concerned, and not by these consumer Terms. Products we manufacture for other brands are subject to those brands' own terms.
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if it is necessary to protect the safety or security of other users or our Service. On termination, the licence granted to you ends and you should stop using the app. Sections that by their nature should survive — such as intellectual property, disclaimers, limitation of liability and governing law — will continue to apply.
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you have where you live, the courts of Shenzhen, Guangdong, China will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.
We may update these Terms from time to time — for example, to reflect new features or changes in the law. When we make a significant change we will update the "Last updated" date above and, where appropriate, let you know in the app. Your continued use of the Service after a change takes effect means you accept the updated Terms.
